    QLD QLDQueensland 491 Visa Small Business Owner Pathway

    This pathway is designed for migrants presently residing in regional Queensland who own and operate a small business. Eligibility criteria include having an occupation listed on the Home Affairs Legislative Instrument LIN 19/051, a positive skills assessment in one of those occupations. The applicant must provide proof of sole ownership of the business; partnerships or joint ventures are not considered eligible.The applicant needs to work for the business for 30 hours per week for at least six months.

    The Small Business Owner (SBO) stream offers two distinct pathways:

    Pathway 1 - (Purchase of business) requires purchasing an existing registered business for at least $100,000, employing an Australian resident, and having the business operational for a minimum of six months before lodging an EOI. The business being bought must have been in operation at its current location for a minimum of two years just before the purchase.

    For applicants who have been residing and working in the NT for at least two consecutive years and are able to show that the employment is available for at least a further 12 months.

    Generally, the applicant need to work in their nominated occupation or an occupation that is related to the nominated occupation.
    NTNT Residents
    For applicants who have been residing in the NT for at least 12 consecutive months; demonstrate full-time employment in the NT in an eligible occupation for at least six consecutive months immediately prior to applying for NT nomination and demonstrate that the employment is available for at least a further 12 months.

    Generally, the applicant need to work in their nominated occupation or an occupation that is related to the nominated occupation. - An exception may be considered.

    Northern Territory residents may be eligible for nomination if they have worked in a critical sector (health, aged and disabled care, education and childcare, hospitality) in the NT for a minimum of 6 months, even if they haven't been employed in their nominated or related occupation for that duration.
    NTNT Graduates in the NT
    Applicants who have completed one or more qualifications following a two-year study at an NT-based institution, either within a single tertiary course or a set of nested tertiary courses, may be eligible to apply.

    NT Graduates may apply for a 190 visa if they have lived in the NT for at least six months immediately after the date of completion of their last qualification, while holding a 485 visa or a bridging visa associated with a subclass 485 visa application;

    This requirement does not apply to graduates who completed all their Australian studies in the NT and cannot qualify for a Temporary Graduate subclass 485 visa solely because of the age limit.

    Applicants are also requird to show genuine efforts to obtain employment from an NT employer in their nominated occupation or a closely related skilled occupation.

    Canberra Matrix: Applicants should express an interest in applying for ACT 190 or 491 nomination by completing a score-based Canberra Matrix where they are allocated points against demonstrated economic contribution or benefit and/or a genuine commitment to be part of the ACT community.

    Canberra residents

    You must meet the following minimum criteria before you are eligible to express an interest in ACT 190 nomination:
    • you need to have resided in Canberra for a minimum of six months at the time of submitting the Canberra Matrix, and this residency must be maintained until the invitation date.
      You are allowed to live within a 30-minute commuting distance in New South Wales, such as in places like Queanbeyan, Jerrabomberra, and Googong.
    • You must meet one of the following three criteria:
      • 1 - Emplyee and/or Self-employed Your nominated occupation is on the ACT Critical Skills List; (Medical Practitioners nec has been in ACT CRITICAL SKILLS LIST - April 2023)

      • 2 - Emplyee on a TSS visa (457/482): You are the primary holder of a subclass 457/482 visa sponsored by an ACT employer; For the past three months, you have been employed in your nominated occupation by an ACT employer who is sponsoring you. It is not mandatory for your nominated occupation to be listed on the ACT Critical Skills List.

      • 3 - Small Business Owner You are the majority owner of a eligible registered business located in the ACT (ineligible businesses: Sub tenancy, ride-share, taxi, delivery, courier services or an on-sold business previously used to qualify for ACT nomination.)
    • It is required that you have worked for a minimum of 30 hours per week in at least 26 out of the 30 weeks preceding the submission
    • You must be in paid employment. Internships, stipends, scholarships and volunteer positions are not considered employment for this criterion.
    • Your income must not be less than the relevant award or market salary rate.
    • If you are employed by an interstate employer while working in Canberra, it is necessary to have a valid and legitimate reason for being physically based in Canberra. Working remotely or from a home office is not permissible.
    • If you are self-employed on an ABN:
      • During at least 26 out of the 30 weeks preceding the submission of the Canberra Matrix, your total taxable income needs to amount to a minimum of $1000 per week
      • you must evidence at least 12 months ACT business activity on your ABN at date of Matrix submission.
    • If you have a Spouse/Partner, they must either be a resident in Canberra or residing overseas.
    • Applicants must demonstrate at least a ‘Proficient’ level of English as defined by Home Affairs (ie IELTS result with a minimum score of 7 (L, R, W, S) or or PTE Academic with a minimum score of 65 (L, R, W, S) unless the nominated occupation is Chef or has an ANZSCO skill level 3 to 5.

    Overseas applicants

    • The nominated occupation must be on the latest ACT Critical Skills List.

    • You need to satisfy the Department of Home Affairs' requirement for 'competent' English, unless your assessing authority demands a higher level.

    Overseas applicants

      "This occupation has been categorised under Gold List (Highest Priority)."
      The applicant must have been working in Tasmania for six months immediately prior to the application for state nomination in an occupation closely related with the applicant's skills assessment (for a minimum of 20 hours per week);

      The applicant must currently be living in Tasmania;

      The applicant's dependants must not be living in another Australian state or territory;

      The employer must be a well-established business that has been actively operating in Tasmania for the past 12 months;

      A genuine need for the position should be satisfied (including a minimum 12-month contract with at least 3 months remaining at the time you apply for nomination).

      The employment must be in an occupation listed on the Tasmanian Onshore Skilled Occupations List (TOSOL)

      Subcontractors may be eligible for this pathway if they have a related skills assessment and at least 12 months business activity in Tasmania.

    • Tasmanian Skilled Graduate Pathway: Available to Tasmanian international graduates who enrolled in a Tasmanian tertiary institution, have been living in the state for at least two calendar years and have completed a course of study be listed on CRICOS with a duration of at least 92 weeks. The course undertaken must be full time and on-site in Tasmania.

      The applicant must be living in Tasmania at time of application and intends to continue living in Tasmania. The study must be:
      • a degree (bachelor, masters or any higher degree), or a diploma or higher (standard, advanced, associate or graduate); or
      • at least Certificate III related to an ANZSCO Major Group 3 or Group 4 occupation, and be listed on CRICOS with a duration of at least 92 weeks.
    • Tasmanian PhD candidates Pathway: Tasmanian PhD candidates who have not completed an undergraduate degree in Tasmania are eligible in this pathway after living in Tasmania and completing at least 2 years of their PhD discipline in Tasmania.
    • Tasmanian Established Resident Pathway: The applicant must have been living in Tasmania for at least 3 years and meets one of the following:

      - Currently be employed in Tasmania in an ANZSCO Skill Levels 1-3, including a cumulative 12 out of the last 24 months (a minimum 20 hours per week on average).

      - Currently be employed in Tasmania, including a cumulative 18 months in the last 3 years, in an ANZSCO Skill Level 4 or 5 (a minimum 20 hours per week on average).
    • Tasmanian Business Operator Pathway (190 Visa Stream): The applicant must have been living in Tasmania for at least 3 years and have operated a business for at least the last 2 years with taxable earnings equivalent to the Temporary Skilled Migration Income Threshold (currently $73,150).
    • Overseas Applicant (Health Sector Job Offer) Pathway:
      - The applicant must have received a formal job offer for a position located in Tasmania that closely matches their nominated occupation.
      - Neither the applicant nor any of their dependents should have resided in any other Australian state or territory in the past 12 months.
      - The applicant needs to have a health or allied health skills assessment for an occupation falling within one of the specified 4-digit ANZSCO groups.

    TASTasmania 491 Visa

    Nomination Criteria:
    • Tasmanian Skilled Employment Pathway:
      "This occupation has been categorised under Gold List (Highest Priority)."
      The applicant must have been working in Tasmania for six months immediately prior to the application average a minimum of 20 hours per week;

      The employment does not need to be related to the skills assessment subject to having relevant qualifications or experience consistent with the ANZSCO definition for that role.

      If the applicant has a skills assessment and related employment in an occupation listed on the Tasmanian Onshore Skilled Occupation List (TOSOL), they may be eligible for nomination after 3 months of employment - Medical Practitioners nec occupation meets this exemption.

      If the applicant is working in a role classified at ANZSCO Skill Level 4 or 5, they are required to have a minimum of twelve months of work experience in Tasmania immediately before submitting their application;
      The applicant's employment must be ongoing, lasting at least six months beyond the application date. The applicant must have relevant qualifications or experience consistent with the ANZSCO definition for that role. Furthermore, there must be a genuine and demonstrated severe labor recruitment difficulty for the position.

      The applicant must currently be living in Tasmania; The applicant's dependants must not be living in another Australian state or territory;

      The employer must be a well-established business that has been actively operating in Tasmania for the past 12 months; A genuine need for the position should be satisfied (including a minimum 12-month contract with at least 3 months remaining at the time you apply for nomination).

      Subcontractors may be eligible for this pathway if they have a related skills assessment and at least 12 months business activity in Tasmania.

    • Tasmanian Skilled Graduate Pathway: Available to Tasmanian international graduates who have been living in the state for at least one calendar year from the commencement of their course and for the duration of their studies.

      The course undertaken must be full time, on-site in Tasmania and be either a bachelor or any higher degree, a diploma, an advanced diploma, or a minimum Cert III related to an ANZSCO Major Group 3 or Group 4 occupation, and be listed on CRICOS with a duration of at least 40 weeks.

    • Tasmanian Established Resident Pathway: The applicant must have been living in Tasmania for at least 2 years (with no more than 50 per cent of total Australian residence period spent in another Australian state or territory) and currently be employed in Tasmania in either:
      - a role equivalent to ANZSCO Skill Level 1-3, including a cumulative 6 months experience at the same level in the last 12 months (a minimum 20 hours per week), or
      - a role equivalent to ANZSCO Skill Level 4 or 5, with a cumulative 12 months experience at the same level or higher in the last 18 months (a minimum 20 hours per week).

    • Tasmanian Business Operator Pathway: The applicant must demonstrate that they have established and operated a business (solely owned or co-owned with spouse) in Tasmania for at least 12 months
      The applicant's business must have provided a personal taxable income to them of at least 85 percent of the Temporary Skilled Migration Income Threshold (i.e. currently $62,178)
      Massage therapy business owners are required to possess a relevant skills assessment and a verifiable health fund provider number.
      Subcontracting business owners are not eligible for consideration under this pathway.

    • Overseas Applicant (Job Offer) Pathway: The applicant must have been offered a formal employment opportunity in Tasmania that closely aligns with their nominated occupation.
      The applicant or any of their dependents should not have resided in any other Australian state or territory within the past 12 months.
      The applicant's employer must have a well-established business that has been actively running in Tasmania for a minimum of 12 months.
      The applicant's salary and working conditions must be equal to or better than what would be offered to an Australian citizen or permanent resident, with the salary at least matching the local market salary rate.
      Massage therapist roles should be situated in either a hospital, aged or disability care environment, or an allied healthcare setting, such as a physiotherapy clinic.
